Terms of Service

⚠️ By registering on YumiScan, you acknowledge having read and accepted all of these Terms of Service. These TOS constitute a legally binding contract between you and the Publisher of the Application.
Article 1 — Purpose and presentation of the service
The YumiScan application (hereinafter "the Application") is a digital service published and operated by YumiScan (hereinafter "the Publisher"), whose purpose is to allow the user to photograph or import an image of an ingredient list in order to obtain an automated analysis intended to identify the ingredients and potential allergens present in a food product.
The Application provides informative assistance only. It does not under any circumstances constitute medical, nutritional, dietary or health advice. The results produced by the Application cannot replace a careful reading of a product's packaging, nor a medical consultation or the advice of a healthcare professional.
Article 2 — Access to the service
Access to certain features of the Application requires:
- The creation of a user account with a valid email address and a secure password;
- The express prior acceptance of these TOS;
- The express acceptance of the health and allergen warning;
- The possession of sufficient scan credits (free upon registration or purchased).
The user guarantees that the information provided during registration is accurate, complete, and up to date. The Publisher reserves the right to suspend or delete any account whose information proves to be incorrect or whose use is contrary to these TOS.
The user is solely responsible for the confidentiality of their login credentials and any use made of their account.
Article 3 — Operation of the scanning service
The scanning service relies on a multi-step technical pipeline including:
- The reception and processing of the image provided by the user;
- Optical Character Recognition (OCR) to extract text from the image;
- The analysis of the extracted text by an artificial intelligence model (Google Gemini);
- The classification of detected ingredients against the allergens and dietary criteria specified by the user in their profile.
The user expressly acknowledges that:
- The quality and reliability of the result depend directly on the quality of the image provided (sharpness, lighting, angle, resolution);
- No automated system, regardless of its sophistication, is free from errors;
- Some ingredients may be poorly detected, partially detected, omitted or misinterpreted;
- Foreign language labels, especially Japanese, are subject to the same limitations as any label, despite the specific optimization of the service;
- A credit is consumed as soon as the processing is effectively launched, regardless of the result obtained.
Article 4 — Allergens and service limitations
The Application allows the user to indicate in their profile the allergens and dietary criteria they wish to monitor (gluten, soy, eggs, crustaceans, peanuts, tree nuts, sesame, milk, fish, halal, vegan, etc.).
The user expressly acknowledges and unreservedly accepts that:
- The Application does not guarantee the exhaustive detection of all allergens present in a product;
- Some substances may be absent from the analysis, ambiguous, misspelled on the source label, or misinterpreted by the algorithms;
- Allergens present as traces, derivatives, or scientific names may not be identified;
- The Application in no way replaces the careful human reading of the product's original packaging;
- In the case of a severe, life-threatening allergy or one requiring absolute vigilance, the Application must not be used as the sole verification tool.
Article 5 — Liability of the Publisher
Within the limits authorized by applicable legislation, in particular the French Civil Code and European consumer law, the Publisher cannot be held liable, directly or indirectly, for damages of any kind (bodily, material, financial, moral) resulting from:
- An error, inaccuracy, or omission in the analysis results provided by the Application;
- A misinterpretation by the user of the displayed results;
- An allergic reaction, a health incident, or bodily injury following the consumption of a food product;
- A temporary or permanent unavailability of the service;
- A loss of data related to a technical malfunction;
- A use of the Application contrary to these TOS.
The Application is provided "as is", without warranty of any kind, express or implied. The user remains solely responsible for their food consumption decisions, regardless of the results displayed by the Application.
In any event, the liability of the Publisher, if it were to be incurred, would be strictly limited to the amount of sums actually paid by the user to the Publisher during the twelve (12) months preceding the generating event.
Article 6 — Prohibited uses
It is strictly forbidden to use the Application:
- For medical, diagnostic, therapeutic, or health counseling purposes;
- As the sole verification tool for severe, serious, or potentially life-threatening allergies;
- To make decisions involving the health of a third party, particularly a child or a vulnerable person, without additional human control;
- For fraudulent, deceptive purposes or contrary to applicable legislation;
- To attempt to access, by unauthorized means, the computer systems of the Publisher or its service providers;
- To bypass or exploit the Application's credit mechanisms.
Article 7 — Specific Artificial Intelligence clause
The Application uses probabilistic artificial intelligence models (Google Gemini). The user acknowledges and accepts that:
- The results are generated automatically by algorithms and are not manually verified by the Publisher;
- AI models can produce incomplete, approximate, inaccurate, or erroneous results, including "hallucinations" (invented information);
- The AI may produce false negatives (allergens present but not detected) or false positives (allergens falsely reported as present);
- The Publisher offers no guarantee of absolute reliability, completeness, or accuracy of the analyses produced;
- In accordance with the European AI Act (Regulation (EU) 2024/1689), the Application is used as a decision support tool and not as a high-impact automated decision-making system.
Article 8 — Credits and payment
The Application operates on a credit system. Each user receives free credits upon registration. Additional credits can be purchased via the Stripe payment platform.
- A credit is definitively consumed as soon as the scan processing is actually launched, regardless of the quality or completeness of the result obtained;
- Purchased credits are non-refundable, except where mandatory legal provisions state otherwise;
- Credits do not expire and remain valid as long as the user account is active;
- In the event of a dispute related to a payment, the user must contact the Publisher through the Contact before any chargeback procedure;
- Any attempted fraud, abuse, or unjustified chargeback will result in the immediate suspension of the account and may lead to prosecution.
Payments are processed exclusively by Stripe Inc., which is PCI-DSS level 1 certified. The Publisher does not store any credit card data.
Article 9 — Termination and suspension
The user can delete their account at any time from the "My Account" page. Deletion leads to the permanent loss of the scan history and remaining credits, with no right to a refund.
The Publisher reserves the right, without notice or compensation, to suspend or delete any account in the event of:
- Violation of these TOS;
- Fraudulent use of the service or credits;
- Unjustified chargeback;
- Provision of false information during registration;
- Abusive behavior towards the service or its providers.
Article 10 — Applicable law and competent jurisdiction
These TOS are governed by French law. In the event of a dispute relating to their interpretation or execution, and failing an amicable resolution within thirty (30) days from the notification of the dispute through the Contact, the parties will submit to the exclusive jurisdiction of the competent French courts.
In accordance with Articles L. 611-1 et seq. of the Consumer Code, a user acting as a consumer has the right to use a consumer mediator free of charge for the amicable resolution of the dispute.
The Publisher reserves the right to modify these TOS at any time. In the event of a substantial modification, the user will be informed by email and must accept the new version to continue using the service.
